A civil lawsuit can be brought against someone who has been charged and is being tried for a crime but they are completely separate from one another. Typically, criminal cases are tried first. The outcome of the criminal trial is not supposed to have a bearing on the outcome of the civil trial. A person may be found innocent in their criminal trial but guilty in a civil trial that addresses damages caused by their crime, or they may be found guilty in a criminal trial but they may prevail in their civil trial.
